And no, simply telling it to read ROMs off of an SD instead won't work, there's all sorts of encryption and anti-piracy code that would need to be bypassed for that, and to get past that crap we need to be able to run unlimited custom code on the DSi/3DS in the first place that can interact with the OS (like how PSP hacks can run virtual device drivers to run ISOs off the memory stick).
The tools and materials are just not available, so why have a modchip? It'd be cheaper to just buy the damn games (up to a point). While it's feasible for any normal person to burn a DVD, it's NOT feasible for any normal person to grab a 3DS game cart and program it.
